Nos Da Healthcare Ltd

Nursing, Care & Support Services

These terms & conditions of business are between Nos Da Healthcare Ltd, registered office; 7 Under Cardiff Road, Bargoed, CF81 8WZ and the ‘client’ who Nos Da Healthcare will introduce temporary workers (‘hereafter called members’.) Nos Da acts as an agent to such temporary workers who enter into a contract for services with the client.

TERMS & CONDITIONS

Terms & Conditions are for the supply of temporary workers. On receipt of signing the timesheet, you are accepting these terms & conditions through the services of Nos Da Healthcare supplied through Nos Da acting as the agent.

  1. Timesheets

Please ensure that a Nos Da Healthcare timesheet is signed for at each assignment. Failure on your part to countersign the timesheet will not affect your liability for payment. The timesheets act as a record of the amount worked upon which the charges to you are final and binding in any event of failure to sign the timesheet. The Yellow copy of the timesheet is for your records and should be kept accordingly. Duplicate timesheets can be provided upon request at a charge of £2.00 per copy.

  1. Payment

All amounts owed to Nos Da Healthcare are payable immediately on receipt of invoices. If paying via a cheque please make payable to Nos Da Healthcare Ltd.

In the event that an invoice is unpaid 30 days after the date of dispatch, Nos Da reserves the right to charge interest at 8% above the Bank of England base rate on the full amount outstanding from the date of invoice to date of payment.

  1. Charges

You will be charged for work undertaken by the Nos Da Healthcare member. These charges will be agreed between Nos Da & the client prior to the assignment commencing. The charge shall consist of the sum calculated by Nos Da Healthcare by applying the hourly rate of payment agreed times the number of hours worked as shown on the timesheet. This will be inclusive of National Insurance contributions and working time regulations. Nos Da Healthcare is required by the Inland Revenue and the Dept of Social Security to deduct Tax & National Insurance where appropriate and are responsible for paying those elements to the collector of taxes.

  1. Permanent Recruitment

If you employ any Nos Da Healthcare member that has been introduced to you by Nos Da Healthcare then you will be required to pay a transfer fee. This one off payment will be charged in consideration of the introduction. This fee is payable whether the approach for employment is made by you, a third party on your behalf or by the Nos Da member applying personally. If you wish to employ a Nos Da member that has been introduced to you beforehand then please contact your local Nos Da office to confirm the fee which will be calculated through a percentage of the member’s expected earnings for the first year.

  1. Cancellations

In the event that a client cancels the assignment of the Nos Da member they reserve the right to charge the following fees.

  1. If cancellation occurs within 4 hours of the assignment commencing, the fee applicable will be the total assignment amount.
  2. If cancellation occurs within 12 hours of the assignment commencing, the fee applicable will be 4 hours of payment.
  3. If a Nos Da Healthcare member conducting an assignment proves unsatisfactory for the client, they may terminate this assignment at any time and ask the member to leave the premises. This needs to be recorded on the timesheet in accordance with clause d), together with the reason for termination.
  4. Nos Da Healthcare shall supply the client with a timesheet upon which the member shall record the number of hours worked. The timesheet will be left with the client for signature. On receipt of this signed timesheet, the client acknowledges that they are satisfied with the Nos Da member and certifies that the number of hours shown on the timesheet have been completed and that they will pay any monies due to Nos Da Healthcare.

6. Responsibilities

    Nos Da Healthcare acts as an agent of the member. Nos Da responsibilities to the client are to ensure that the qualifications and references of the members are relevant and to select people suitable for the introduction to clients. Any particular skills, training & qualifications required of a Nos Da Healthcare member must be clearly identified at time of booking. 

While on duty, Nos Da members are responsible for their own professional conduct. Nos Da Healthcare excludes any liability (whether direct, contingent or consequential) for any costs, claims, damages, demands or expenses in connection with the services provided whether this is from Nos Da failing to provide a member, the non attendance of a Nos Da Healthcare member, negligence dishonesty, misconduct, lack of skill of a member or from any other cause whatsoever except where any such costs, damage, demands or expenses are directly caused by the negligence of Nos Da Healthcare Ltd.
